Touch Sales Agreement

This agreement governs your purchase or pre-order of a Touch ring and any sizing kit from ORB AI INC. (“ORB,” “we,” or “us”). Read it before accepting. Your selected design, sizing choice, checkout price, applicable taxes, and order confirmation form part of this agreement. Contact: alireza@orbai.ai.

1. Your order and today’s payment

The invitation offer costs $99 for a Touch ring with 4 months of Pro included. The ring-only offer costs $69, requires no invitation, and includes no AI agent. A waitlist pre-order costs $30 today, credited toward the $99 ring price, with $69 remaining when you receive an invitation and complete the ring purchase. Existing $50 pre-orders retain their original $50 credit and $49 remaining balance. A pre-order reserves a place on the waitlist; it does not mean a ring has shipped or guarantee immediate availability. An invitation is required for the $99 offer and legacy balance checkout. Any displayed taxes are additional. Shipping is available to the United States, South Korea, the United Kingdom, Germany, Indonesia, Argentina, India, Japan, Brazil, Australia, Canada, France, the Philippines, Taiwan, New Zealand, Singapore, Malaysia, Italy, Spain, the Netherlands, Belgium, Switzerland, Austria, Ireland, Sweden, Norway, Denmark, Finland, Poland, and Portugal.

The optional sizing kit costs $2.50; it is not free. Selecting it adds $2.50 to today’s order. We ship the kit first so you can confirm your ring size before your ring ships. The kit fee is separate from the $30 credit toward the ring price. We will obtain your final size before shipping the ring if you select a sizing kit.

2. Non-refundable purchases and exceptions

Ring purchases, pre-order payments, and sizing kit purchases are final and non-refundable for a change of mind, except as required by applicable law or expressly agreed by ORB in writing. This policy does not remove mandatory rights relating to non-delivery, shipping delays, defective or nonconforming goods, unauthorized charges, statutory cancellation rights, or any other non-waivable consumer protection. It does not prevent you from raising a good-faith payment dispute.

If ORB cancels an unfulfilled order or cannot supply the ordered product, we will refund the payment for that unfulfilled product. Any legally required refund will be made promptly through the original payment method where available. Contact us promptly about an incorrect, damaged, defective, or missing item so we can investigate and provide the remedy required by law or the applicable written warranty.

3. Delivery, delays, and pre-order status

A delivery or shipment date expressly stated for your order is part of the order terms. A pre-order is not a promise of immediate shipment. We will communicate availability and any revised shipment date. If a promised or legally required shipment deadline cannot be met, we will provide the notices and options required by law, including the choice to affirmatively consent to a delay or cancel unshipped merchandise for a prompt refund. We do not treat silence as consent where affirmative consent is required. If no shipment time is specified, applicable statutory shipment deadlines apply.

You must provide a correct delivery address in a supported country and accurate contact details. Contact us before shipment to request changes; changes are subject to feasibility. Keep packaging and contact us if shipment is lost or damaged. Nothing in this agreement transfers to you a risk of loss that applicable law requires ORB to bear.

4. AI agent options and separate recurring billing

The $99 invitation offer includes 4 months of Pro from activation at shipping. After the included period, you may keep Pro or switch to Starter at $10/month. The $69 ring-only offer includes no AI agent: Touch Agent plans start at $10/month, and connecting Muse or Dots costs $4.99/month. Third-party account fees may be separate. An active AI agent is needed for AI functionality.

No recurring fee is charged or authorized by today’s purchase. Before any recurring billing starts, we will present the selected plan’s price, renewal schedule and cancellation method and obtain your separate, express affirmative authorization. You will receive a retainable confirmation of those terms.

You may cancel recurring renewal through the online cancellation method provided at activation, or contact alireza@orbai.ai for cancellation help. Cancel before the next billing date to prevent the next monthly charge. Unless applicable law or a written offer requires otherwise, cancellation ends renewal and service remains available through the paid billing period; paid monthly fees are not prorated for unused time. Cancellation of membership does not create a return right for the ring beyond applicable law. We will provide any legally required renewal reminders and advance notices of changes; changes requiring new consent will not be charged without that consent.

5. Compatibility, sizing, and product information

You are responsible for selecting a supported size and verifying compatibility with the watch, operating system, phone, connectivity, and third-party accounts you intend to use. Touch requires supported software and an active account. Features may depend on internet access, connected services, permissions, regional availability, and a membership. Product images show the intended design. During initial fulfillment, customers may receive a ring whose appearance does not exactly match the design shown on the website. The shape, finish, or other visual details may differ. This notice does not change the ordered size or advertised functionality, or limit your rights concerning defective or nonconforming goods. Unannounced weight, battery, and availability specifications are not promised specifications.

Easy ring-size exchanges. If your ring does not fit, you can send it back to ORB and exchange it for a different size. Contact alireza@orbai.ai with your order number before returning the ring so we can arrange the return and replacement size. This exchange option is separate from the change-of-mind refund policy in section 2 and does not limit your mandatory consumer rights.

Use the sizing guidance or kit carefully. Do not wear a ring that is uncomfortably tight or causes irritation. Follow the provided care, charging, and safety instructions. Touch is not an emergency service, medical device, or substitute for professional advice.

6. AI features and connected services

AI output may be inaccurate or incomplete. Review important output and confirmations before relying on them, especially for messages, purchases, bookings, health, finances, or other consequential decisions. You control the accounts and permissions you connect. Do not use Touch unlawfully, infringe others’ rights, or bypass security protections. Third-party services are governed by their own terms and may change, become unavailable, or require separate fees. Muse, Dots, and other third-party agents or connections may be unavailable or may not work with Touch. Their availability and functionality are not guaranteed.

7. Warranty and remedies

Any additional written product warranty supplied with your ring governs its stated coverage. We do not waive or limit warranties, repair/replacement obligations, or remedies that applicable law makes mandatory. This agreement does not promise an additional warranty period that has not been offered in writing.

8. Liability

To the extent permitted by law, ORB is not liable for indirect or consequential losses arising from unsupported use or reliance on inaccurate AI output. To the extent a limitation is lawful, ORB’s aggregate contractual liability is limited to the amount you paid for the affected product and, for membership-related claims, the affected membership fees paid in the preceding twelve months. These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury, statutory product liability, or any liability or remedy that cannot legally be excluded or limited.

9. Privacy and payment processing

Your account and order information are processed under the ORB Privacy Policy and applicable Touch privacy information. Stripe processes your payment information. ORB retains necessary order, payment, and agreement acceptance records for fulfillment, support, fraud prevention, and legal obligations. Never enter another person’s payment details without authorization.

10. General terms and your acceptance

You must be at least 18 and have authority to place the order. California law and applicable US federal law govern this agreement, without limiting mandatory consumer rights applicable to you in your country of residence. A court with lawful jurisdiction may hear disputes; this agreement does not impose an arbitration requirement or waive non-waivable rights. Contact ORB first if you need help resolving an order issue. If a term is unenforceable, the remaining terms continue to apply to the extent lawful. Later changes do not retroactively remove rights attached to an existing order.

By selecting “Accept sales agreement,” you affirmatively accept this version of the Touch Sales Agreement for your purchase or pre-order, including the payment amounts, non-refundable policy and mandatory exceptions, and the AI-agent inclusions and separate recurring-billing terms for your selected offer. You are not authorizing or starting a recurring subscription today.
